5. Pricing and Payment Terms

5.1 Pricing Structure

We offer the following pricing options:

• All payments are processed securely through Stripe
• We accept major credit cards and debit cards
• You authorize us to charge your payment method for all fees incurred
• You are responsible for all applicable taxes

5.3 Subscription Auto-Renewal

Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. You will be charged the then-current subscription price.

5.4 Price Changes

We reserve the right to change our prices at any time. For subscriptions:

• Price changes will not affect your current billing period
• You will be notified at least 30 days before any price increase
• Continued use after price change constitutes acceptance
• You may cancel before the price change takes effect

5.5 Failed Payments

If a subscription payment fails:

• We will attempt to charge your payment method multiple times
• Your subscription may be suspended until payment is successful
• Your subscription may be cancelled if payment fails repeatedly
• You remain responsible for any unpaid amounts

6. Refund Policy

6.1 One-Time Purchases

We offer refunds for one-time resume purchases ($14.99) under the following conditions:

• Timeframe: Request must be made within 7 days of purchase
• Eligibility: You are dissatisfied with the quality of the generated resume
• Process: Email heroservices.ai@gmail.com with subject "Refund Request" and include your order number
• Decision: Refunds are granted at our discretion on a case-by-case basis
• Processing: Approved refunds are processed within 5-10 business days

6.2 Subscriptions

Subscription refunds are handled as follows:

• No Partial Refunds: We do not offer prorated refunds for cancelled subscriptions
• Current Period: You retain access until the end of your current billing period after cancellation
• First Charge: If you cancel within 48 hours of your first subscription charge, we may offer a refund at our discretion
• Technical Issues: If the Service is unavailable for extended periods, we may offer prorated credits or refunds

• Clicking "Manage Subscription"
• Selecting "Cancel Subscription"

• Your subscription will remain active until the end of your current billing period
• You will not be charged for subsequent billing periods
• You retain permanent access to all resumes created during your subscription
• You can reactivate your subscription at any time

7.3 Cancellation Feedback

When you cancel, we may ask for optional feedback to help us improve our Service. This feedback is voluntary and will be used solely for service improvement purposes.

8. User Responsibilities and Acceptable Use

8.1 Your Obligations

When using our Service, you agree to:

• Provide accurate and truthful information about your experience and qualifications
• Use the Service only for lawful purposes
• Comply with all applicable laws and regulations
• Respect the intellectual property rights of others
• Not misuse or abuse the Service

8.2 Prohibited Activities

You may NOT:

• Abuse the System: Make excessive API calls, spam requests, or attempt to overload our servers
• Share Accounts: Share your account credentials or allow others to use your account
• Reverse Engineer: Attempt to reverse engineer, decompile, or extract our AI algorithms or source code
• Scrape or Copy: Use automated tools to scrape, copy, or download content from our Service
• Fraudulent Activity: Use stolen payment methods, create fake accounts, or engage in payment fraud
• Resell Services: Resell, redistribute, or commercially exploit our Service without authorization
• Harmful Content: Submit false, misleading, defamatory, or illegal information
• Security Violations: Attempt to breach security, access unauthorized areas, or interfere with Service operation
• Impersonation: Impersonate others or falsely claim affiliations

8.3 Consequences of Violations

Violation of these terms may result in:

• Immediate suspension or termination of your account
• Forfeiture of any unused subscription time (no refund)
• Legal action and liability for damages
• Reporting to law enforcement if illegal activity is suspected

9. Intellectual Property Rights

9.1 Your Content

You retain all ownership rights to the content you provide (your personal information, experience, education, skills, etc.) and the resumes generated from your content.

You Own Your Resumes: All generated resumes are your property. You may use them for any lawful purpose, including job applications, portfolio websites, and personal use.

9.2 License You Grant Us

By using our Service, you grant us a limited, non-exclusive, worldwide license to:

• Process your content through our AI systems and third-party services (OpenAI)
• Store your content in our database (Supabase)
• Display your content back to you in your dashboard and generated resumes
• Use anonymized, aggregated data for service improvement and analytics

This license ends when you delete your account, except for anonymized data used in aggregated analytics.

9.3 Our Intellectual Property

We own all rights to:

• The HERO.AI platform, website, and software
• Our AI algorithms, prompts, and translation logic
• Our branding, logos, and trademarks
• Our database structure and architecture
• All documentation, guides, and marketing materials

You may not copy, modify, distribute, sell, or create derivative works from our intellectual property without written permission.

9.4 Feedback

If you provide feedback, suggestions, or ideas about our Service, you grant us a perpetual, irrevocable, worldwide license to use that feedback without compensation or attribution.

Best Practice: Treat AI-generated resumes as a strong starting point, not a final product. Always review, edit, and personalize the content before submitting to employers.

11. Disclaimers and Limitations of Liability

11.1 Service "As Is"

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability, fitness for a particular purpose, or non-infringement
• Warranties that the Service will be uninterrupted, error-free, or secure
• Warranties regarding the accuracy, reliability, or quality of AI-generated content
• Warranties that the Service will meet your specific requirements or expectations

11.2 No Employment Guarantees

11.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HERO.AI SHALL NOT BE LIABLE FOR:

• Indirect Damages: Lost profits, lost opportunities, lost data, or consequential damages
• Job Search Outcomes: Failure to obtain employment, interviews, or job offers
• AI Errors: Inaccuracies, errors, or inappropriate content in AI-generated resumes
• Third-Party Services: Issues with OpenAI, Stripe, Google, or other third-party services
• Data Loss: Loss of your resume data due to technical failures (maintain your own backups)
• Service Interruptions: Downtime, maintenance, or service unavailability

11.4 Maximum Liability

Our total liability to you for any claims arising from or related to the Service shall not exceed the greater of:

• The amount you paid us in the 12 months preceding the claim, OR
• $100 USD

11.5 Jurisdictional Limitations

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for incidental or consequential damages. In such jurisdictions, our liability will be limited to the maximum extent permitted by law.

You agree to indemnify, defend, and hold harmless HERO.AI, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from or related to:

• Your use or misuse of the Service
• Your violation of these Terms
• Your violation of any third-party rights, including intellectual property rights
• False, misleading, or inaccurate information you provide
• Your resume content and how you use it

13. Third-Party Services and Links

Our Service integrates with and relies on third-party services:

• OpenAI: AI content generation
• Stripe: Payment processing
• Google: Authentication
• Supabase: Data storage

Your use of these third-party services is subject to their respective terms and privacy policies. We are not responsible for the practices, content, or availability of third-party services.

Our Service may contain links to third-party websites (e.g., job posting URLs you analyze). We do not endorse or assume responsibility for any third-party content, websites, or services.

By using our Service, you consent to our collection and use of your information as described in the Privacy Policy.

15. Dispute Resolution and Arbitration

15.1 Informal Resolution

Before filing a claim, you agree to contact us at heroservices.ai@gmail.com to attempt to resolve the dispute informally. We will attempt to resolve the dispute within 30 days.

15.2 Binding Arbitration

If we cannot resolve the dispute informally, you agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding arbitration, rather than in court, except that:

• You may assert claims in small claims court if your claims qualify
• Either party may seek injunctive or equitable relief in court for intellectual property infringement

15.3 Class Action Waiver

YOU AND HERO.AI AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

Unless both you and HERO.AI agree otherwise, the arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding.

15.4 Arbitration Rules

The arbitration will be conducted by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitrator's decision will be final and binding.

16. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of [Your State], without regard to its conflict of law provisions.

Any legal action or proceeding (other than arbitration) shall be brought exclusively in the federal or state courts located in [Your County, Your State], and you consent to the personal jurisdiction of such courts.

18. General Provisions

These Terms, together with our Privacy Policy, constitute the entire agreement between you and HERO.AI regarding the Service and supersede all prior agreements.

18.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

18.3 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

18.4 Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms without restriction.

18.5 Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, war, terrorism, riots, natural disasters, or failures of third-party services.

Sections that by their nature should survive termination of these Terms shall survive, including but not limited to: Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, and Dispute Resolution.
